Are the yukkuri "copyrighted"?

Let's say that I want to make an anime out of these surreal creatures, but as they take after Touhou characters, ZUN and his company (companies?) may sue me, right?

Now for that situation, if I drew yukkuri, but made them not resemble any Touhou characters, just with plain hair, braids and accessories that also didn't resemble any of the Touhou's, would that go away well?

I once "heard" that Yukkuri started from a kind of "meme". Probably its not copyrighted. The creature itself I believe its not. But be careful with names and some resemblance of the characters. It can be a catch for a sue.

Marisa => Mari.
Alice => Ace.
Chen => Chin.
Myon => Mon.
Patchy => Pats.
Remi => Ren.
Flan => Flen.
Kimemaru => Aya.
Meiling => Mai.
Cirno => Cill.

I'd give a try for the names the fandom created (I'm not sure about this. I know nothing about Touhou. Correct me if I'wrong), like Macha/Maricha, etc. Maybe it wouldnt fit well since these names are said by Kos or idiot Yukkuris. But are names we are more used to.

The first names aren't copyrighted.
While it's true that no one in Japan is called Sumireko (or anyway it's a really uncommon name), ZUN can't sue anyone for calling a girl Sumireko.
The copyrighted character is Sumireko Usami and she is a girl that can travel to a different world when sleeping.
The real issue comes from the fact that yukkuri are heads looking like ZUN's characters, but we need a lawyer here.
Meanwhile, since ZUN has never complained, as long as you use yukkuri outside of Gensokyou you're fine.

Generally, ZUN has been taking it easy with the yukkuri fandom. There was one reference to taking it easy (using "ゆっくり" in grammatical context, for lack of better words) in the last panel of one official Touhou manga.

I didn't know about that page, thanks for sharing.
It still makes yukkuri somewhat borderline, but more on the safe side than not, so we should be fine.
